Mark F Anderson has represented consumers in lawsuits against Experian, Equifax, Trans Union and banks and others that report credit information to those companies. He has settled over 30 such cases in recent years. The majority of the cases involved inaccurate credit information. In the typical inaccuracy case, the credit reporting agencies are reporting negative, inaccurate information that they have failed and refused to correct upon notice from the consumer of the inaccuracy. The types of inaccuracies include late payments on accounts, accounts that do not belong to the consumer, and fraudulent accounts.

Mark currently represents a consumer whose credit files were mixed with another consumer who had the same name and same social security number. The consumer tried many times to get the consumer reporting agencies to unmix her accounts from the other person without success. It took a lawsuit to get the agencies to unmix her accounts.

When, as happens all too frequently, someone steals a consumer’s identity, the consumer’s credit report may be impacted. Under the FCRA, when the consumer gives the agencies notice he or she is a victim of identity theft, the agencies are supposed to correct the consumer’s report. In some instances, this just does not happen. In such cases, the agencies are liable for damages to the consumer.
